74 WSURA 92ND Street Resident Association Meeting

Five Officers to be Elected: President, Vice President, Treasurer, Secretary, and Sergeant-at-Arms (Those running for office must be at the meeting to complete the nominations form and accept the nomination.)

REQUIREMENTS TO SEEK OFFICE and VOTE: Designated head of household (any age) and other members who are 18 years or older and listed on the household composition can vote. In addition, candidates must be in good standing with NYCHA.

Eligibility to run for and hold office on a NYCHA Resident Council:

  • All candidates must be current with their rent. For arrears that accrued after March 13, 2020, tenants must have given consent to NYCHA to apply for ERAP on their behalf.
    • If a tenant is currently in compliance with their rental payment agreement, the “current in rent” requirement shall be deemed satisfied.
  • A tenant is disqualified from running for office if the Office of Impartial Hearings (OIH) has issued an administrative determination of lease non-compliance.
    • Tenants with pending cases with the Law Department or those who are currently appearing in front of the OIH are presumed compliant until OIH issues its determination.
    • Cases settled by simulation do not disqualify a tenant, so long as the tenant is in compliance with the terms of the stipulation.
    • An exception to the above rule is the following: if there are circumstances involving the tenancy which create an immediate threat to the health and safety of other tenants or NYCHA property, (including criminal activity), NYCHA’s Law Department will review these cases to determine eligibility. These cases should be brought to Resident Engagement and then forwarded to the Law Department for review.
  • Any tenant who fails to fully comply with the terms or conditions of any determination, recommendation, instruction, directive, settlement, or the equivalent, issued by the NYCHA Department of Equal Opportunity or Law Department, the New York City Law Department, the NYCHA Office of the Inspector General, the New York City Department of Investigation, or a third-party investigator, is not eligible to hold or run for RA office. Upon a showing of non-compliance, any tenant-candidate running for TA office will be automatically disqualified from future consideration, and any tenant currently holding a PA office shall immediately resign from any office held. A failure to resign will result in NYCHA’s withdrawal of recognition of the RA. Proof of non-compliance sufficient to render a tenant ineligible for RA office must be made by credible evidence.

NOTE: ELIGIBLE VOTERS CAN OBTAIN A BALLOT ON ELECTION DAY.

Elegibilidad para postularse y ocupar un cargo en un consejo de residentes de NYCHA:

  • Todos los candidatos deben estar al día con su alquiler. Para los atrasos que se acumularon después del 13 de marzo de 2020, los inquilinos deben haber dado su consentimiento a NYCHA para solicitar el ERAP en su nombre.
    • Si un inquilino actualmente cumple con su acuerdo de pago de alquiler, se considerará satisfecho el requisito de “alquiler actual”.
  • Un inquilino está descalificado para postularse para un cargo si la Oficina de Audiencias Imparciales (OIH) ha emitido una determinación administrativa de incumplimiento del contrato de arrendamiento.
    • Se presume que los inquilinos con casos pendientes con el Departamento Jurídico o aquellos que actualmente comparecen ante la OIH cumplen hasta que la OIH emita su determinación.
    • Los casos resueltos por simulación no descalifican a un inquilino, siempre que el inquilino cumpla con los términos de la estipulación.
    • Una excepción a la regla anterior es la siguiente: si existen circunstancias relacionadas con el arrendamiento que crean una amenaza inmediata para la salud y la seguridad de otros inquilinos o la propiedad de NYCHA (incluida la actividad delictiva), el Departamento Legal de NYCHA revisará estos casos para determinar la elegibilidad. . Estos casos deben llevarse a Resident Engagement y luego enviarse al Departamento Legal para su revisión.
  • Cualquier arrendatario que no cumpla en su totalidad con los términos o condiciones de cualquier determinación, recomendación, instrucción, directiva, acuerdo o equivalente emitido por el Departamento de Igualdad de Oportunidades de NYCHA o el Departamento Legal, el Departamento Legal de la Ciudad de Nueva York, la Oficina de NYCHA del Inspector General, el Departamento de Investigación de la Ciudad de Nueva York, o un investigador externo, no es elegible para ocupar o postularse para el cargo de RA. Si no se presenta la renuncia, la NYCHA retirará el reconocimiento de la RA. La prueba de incumplimiento suficiente para hacer que un inquilino no sea elegible para el cargo de RA debe hacerse mediante evidencia creíble.
